In 2008 the existing application process for the HSMP system will be phased out and will be replaced by a new points based system. This shake up will see the introduction of 5 new tiers aiming to consolidate 80 pre-existing work and study routes into the UK, identify the most talented workers and reduce abuse of the immigration system.
Who will be affected?
The new visa system will concern many people seeking a UK Visa, particularly those currently in the UK wishing to renew their visa or extend their stay and those with the existing HSMP or those who wanted to apply for a HSMP. Because the system is being introduced in phases, it can cause problems for those already in the UK. The home office guidelines are as follows:
You can only apply for Tier 1 (General) - highly skilled worker now if you are:
- In the United Kingdom and want to make an initial application for the Tier 1 (General) - highly skilled worker category;
- Already in the United Kingdom under Tier 1 (General) - highly skilled worker and want to extend your permission to stay within your existing category;
- Already in the United Kingdom under the Highly Skilled Migrant Programme, want to extend your permission to stay and are eligible to switch into Tier 1.

What are the 5 tiers?
- Tier 1: Highly skilled individuals to contribute to growth and productivity;

- Tier 2: Skilled workers with a job offer to fill gaps in United Kingdom labour force;
[Work Permit]
- Tier 3: Limited numbers of low skilled workers needed to fill temporary labour shortages;
- Tier 4: Students;
- Tier 5: Youth mobility and temporary workers: people allowed to work in the United Kingdom for a limited period of time to satisfy primarily non-economic objectives.

Points Based System
Each tier will be affected by the point’s assessment, with Tier 1 being introduced in India from the 1st April and to be implemented in other countries over summer 2008. View the timetable here. Applicants will be awarded points for attributes including: age, previous/prospective salary, qualifications, UK experience, English Language and maintenance (funds). Under Tier 1 a total of 95 points are needed (you must have 10 points each for English Language and Maintenance). To work out if you qualify check the online points calculator.
Visa Sponsorship
Another major change to the visa and immigration system is the introduction of Sponsorship Duties, where employers and institutions will be licensed to sponsor and bring migrants to the UK. Only those employers that meet government criteria will be awarded an “A rating”. However sponsorship is only needed for applicants in Tiers 2 – 5 and does not affect those applying under Tier 1.
