International Contracting in Europe
In addition to contracting in the UK outside the scope of the AWR as a PAYE employee or as a Limited Company Contractor BITE together with it’s associates provide the opportunity to contract in Europe with a number of easy solutions that vary by country.
Essentially if you are resident in the UK and contracting in a European country you can work in that country without being taxed locally in most cases as long as you have a passport or work visa that allows you to do so. Generally consultant contractors with the correct National Insurance Certificate can work for up to 6 months without the risk of double taxation.
Anyone working for more than 6 months or in some specific countries will need a locally based payroll soloution or need to work as a self employed registered person in that country. This needs to be set up correctly to ensure that you are legally working in that country and do not incur any tax penalties. This is known as the 183 day ruling, where in short contracts the contractor remains tax resident in the UK.But this does not mean that the contractor will not need to pay local taxes straight away on the contract income that isn’t earn’t within the UK (tax treaties ensure that they don’t pay local and UK tax on those earnings).
As a result in most cases the contractor would be registered locally from the start of the contract in order to be fully compliant with the local authorities. As the employer we’d then deduct relevant amounts of local tax and Social Security from the gross earnings before forwarding the net amount to the contractor.
A generic worldwide bill and pay solution for contractors working on a self employed basis is offered. This is ideal for unusual locations where employed solutions are ruled out for commercial reasons and for mainly middle eastern and African locations where earnings are potentially tax free for a period.
Generally the fee for handling an international contract is £59.50 per week worked plus BITE’s general Contract Administration credit control fee of 5% in addition to any other services requested. This will sometimes vary between countries.
