In short the managed service company legislation will not affect you if you contract through BITE.
1. BITE Consulting as a consultancy provides a specialist resourcing service for agencies in the UK in the IT, Accounting, Finance and Banking sectors – BITE is not an agency or competitor but a highly effective resource supplier to agencies
As an employment business providing work finding services, BITE falls within the exemption under Section 613(4) of Schedule 3, Part 1 TEPA 2003, the Managed Service Companies legislation and therefore doe not expose agencies or end clients to any debt transfer risk.
BITE is a niche provider of resource services for the provision of highly skilled IT and General Interim Consulting professionals
BITE provides it’s unique candidates resourcing service through:
(a) Ensuring all candidates are met face to face, interviewed and referenced
(b) Engaging candidates as either employed consultants or freelance contractors according to their individual status
(c) Ensuring all Consultants/Contractors’ status is outside the scope of the Agency Workers Regulations (AWR) thereby reducing agency administration requirements through:
(i) PAYE Consultants being employed via an overarching contract of employment with 50% of pay between assignments
(ii) Contractors operating as an ‘Opted out Ltd Company contractor engaged to work outside of IR35’
(d) Offering an indemnity to Agencies that their consultant/contractors are outside the AWR & MSC legislation and any resultant claim that may be brought against them or their client through engaging one of their consultant contractors.
(e) BITE does not deal with contractors who wish to operate via an Employee benefit trust (EBT), Offshore Ltd Company or who cannot supply suitable references, legal entitlement to work in the UK or who will not participate in professional skill/competency testing
2. Agencies can engage BITE’s Consultants/Contractors through either a simple Consultancy/Limited Company contract or a business to business supplier agreement or their own agreement or commercial umbrella agreement. BITE can provide legally approved REC contracts or agree to use the agency’s own contract.
Bite’s resourcing services are provided free to Agencies. BITE’s income is generated by charging the consultant contractor fees for its Career Consultancy, training and payroll services.
BITE will provide:
(i) Company details, registration number and address
(ii) VAT number/certificate
(iii) Insurance certificates
(iv) AWR indemnity
(v) MSC indemnity
(vi) A Contractor portal for contracts and compliancy approvals
