AWR 2011

From April 2011 new legislation provides agency workers the entitlement to the same or no less favourable treatment with respect to basic employment and working conditions, if and when they complete a 12 week qualifying period . The legislation does not greatly affect well paid contract professionals either; employed PAYE permanently by a consultancy and paid between assignments” the Swedish Derogation” or engaged through a Personal Service Company (PSC or TLC) that has opted out and is operating outside IR35. However working outside the scope of the regulations will provide real benefits to many agencies.
